In dieser Hausarbeit werde ich mich mit dem § 4 des Gesetzes über die Datenverarbeitung der Polizei (PolDVG) befassen.
Zuerst beschäftige ich mich mit der Begrifflichkeit und den verschiedenen Arten der Identitätsfeststellung.
Ich werde auf die einzelnen Absätze des § 4 PolDVG näher eingehen und die damit verbundenen Grundrechtseingriffe untersuchen.
Als Schwerpunkt habe ich die lageabhängigen (verdachtsunabhängigen) Kontrollen im Absatz 2 des § 4 PolDVG gewählt. Dieser Abschnitt wurde völlig neu eingeführt und schafft für die Polizeibeamten die Möglichkeit, in bestimmten Gebieten Personenkontrollen auch ohne Verdachtsmoment durchzuführen. Dies bringt viele Vorteile mit sich, schafft aber auch gewisse Probleme. Damit werde ich mich ebenfalls auseinandersetzen. Hamburg übernimmt mit den lageabhängigen Kontrollen bei weitem nicht die Vorreiterrolle, sondern schließt als eines der letzten Bundesländer an die Vorreiter Bayern und Baden-Württemberg an. Dennoch sind die lageabhängigen Kontrollen in Hamburg etwas Besonderes, da sie als Voraussetzung nicht die grenzüberschreitende Kriminalität oder die unerlaubte Einreise haben. Ich schließe die Arbeit mit einer Zusammenfassung über beide Themenschwerpunkte (Identitätsfeststellung und lageabhängige Kontrollen) ab.
